Teleconference: The Evolution of IRS Retirement Plan Programs: Determination Letters and EPCRS

For attorneys and their clients who work with employer sponsored retirement plans, two critical programs offered by the Internal Revenue Service are the determination letter program and the Employee Plans Compliance Resolution System ("EPCRS"). This teleconference, sponsored jointly by the Employee Benefits and Executive Compensation Committee of the New York City Bar and the New York City Chapter of Worldwide Employee Benefits (WEB), will focus on the current status of these two programs. The IRS has announced major changes to the determination letter program that will affect not only the operation of retirement plans but other areas where retirement plans are at issue, including mergers and acquisitions, coverage under the securities laws, and bankruptcies. EPCRS remains a heavily used program, and the IRS has recently implemented important changes to its rules affecting how corrections are made to fix some common plan errors.
In this program, Speaker Elizabeth Dold will address the changes coming to the determination letter program and consider how they will affect retirement plan administration and other matters. Speaker Scott Feldman will focus on recent updates to EPCRS and practical considerations to keep in mind when using the correction program. There will be an opportunity to ask questions of both speakers.
