About the Program
Ethical issues can arise in special and unusual ways in the area of Employee Benefits and Executive Compensation — they can surface in the context of fiduciary duty, conflicting employer/employee interests, and heightened regulatory exposure. As retirement security remains a front-page concern and ERISA litigation continues to surge, benefits attorneys should be increasingly attuned to these issues.
Join the NY Chapter of WEB and Andrew Oringer — General Counsel and head of the New York office of The Wagner Law Group, and Chair of the New York State Bar Association (NYSBA) Committee on Attorney Professionalism - for a practical look at the ethical questions that arise most often in this practice area, along with real-world answers and best practices for addressing them.
Topics to be covered:
- Identifying the client — Clarifying who the attorney represents in complex plan sponsor, plan, and fiduciary relationships
- Representing multiple constituents — Assessing when representing multiple parties within a single organization is permissible, and navigating conflicts when interests diverge
- Executive compensation — Additional regulatory obligations facing attorneys advising on executive compensation
- Attorney-client privilege — The scope and limitations of the privilege
The learning objective of this program is to help attorneys and other employee benefits professionals and their advisors better understand the roles attorneys may take in employee benefit plan matters, the rules applicable in certain highly regulated areas, and the times when privilege may not apply.

Meet the Speaker
Andrew L. Oringer Partner and General Counsel, Wagner Law Group
Drew heads the Wagner Law Group's New York office and serves as the firm's General Counsel. His expertise extends to a broad array of issues relating to ERISA and executive compensation. He advises clients regarding their pension and welfare plans and arrangements, benefits-related tax matters and fiduciary issues arising in connection with the investment of plan assets, and he has extensive experience with executive compensation representing employers as well as individual executives. Drew is also the Chair of the New York State Bar Association (NYSBA) Committee on Attorney Professionalism (CAP).
CLE & Other Continuing Education Credits
This program is approved for 1 hour of CLE credit for attorneys licensed in the State of New York It is appropriate for attorneys of all levels of experience.
This program can also be self-submitted for 1 HRCI and SHRM credit.
